Hi, I would like to clarify on a buyback loan. So we are late on Pagibig by 4 months(this happened Sept -Dec 2022) then they demand for us to pay in which we do however we cant make payment until of March 2022 due to the account was FARD( freeze?) we settled partially as we are not aware of the penalties and such then we were notified that the property was bought back by the developer knowing that we are still paying on PAGIBIG. We would like to know if we can still have this settled on their end to extent to have our loan on PAGIBIG reinstated.
28 October 2022 Dear MS. RIZZA MAE M. VISCA, This refers to your eFOI request received on 27 October 2022 sent to the eFOI portal of the Home Development Mutual Fund (Fund) wherein you sought clarification regarding your housing loan. You informed us that you were late on your payments by four (4) months and a demand to pay was already issued by the Fund. You said that you only partially paid your arrearages as you were not aware of the penalties. You also mentioned that you were notified that the property was bought back by the developer. You are now inquiring whether you could settle your arrearages and have your housing loan reinstated. Kindly be informed that Section 3 of Executive Order No. 2, series of 2016 (Executive Order) grants every Filipino citizen the right to access information, official records, public records and to documents and papers pertaining to official acts, transactions or decisions, as well as to government research data used as basis for policy development. In accordance with the aforementioned Executive Order, the Pag-IBIG Fund People’s Freedom of Information Manual (Manual) also states that “Information for Disclosure” includes: information promoting the awareness and understanding of policies, programs, activities, rules or regulations affecting the public, government agencies, and the community and economy (Section 2 of the Manual). In other words, the nature and subject of requests for information pursuant to Executive Order No. 2, series of 2016 refer to the right of Filipino citizens to information on matters of public concern. It excludes requests pertaining to personal transactions with the Fund, which necessarily involves disclosure of personal information. Considering that your request pertains to your and your brother’s personal transaction and record with the Fund, this is not covered under the aforementioned Executive Order and Manual. Nevertheless, we took the liberty of endorsing your request to the operating unit concerned – the Housing Operations Support Unit (HOpS).
