Hi would like to request a BIR 2316 for November 2020 to November 2022 from your office. I was not able to process my clearance from my previous employer due to declining health of my mother. As of now my new employer is asking for a copy of BIR 2316 in which I was not able to provide.

Dear Mr. Ramos:
I refer to my letter of Jan 25, 2023 09:42:49 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for a copy of your BIR Form No. 2316 for Taxable Year 2020 to 2021.
In order for us and the BIR Revenue District Office (RDO) to work further on your request, we need more information from you regarding your query. Kindly provide us the following data in order for us to evaluate your requested information:
1. Your Tax Identification Number (TIN);
2. Complete Name of your Employer (Taxable Year 2020 - 2021);
3. TIN of your Employer; and
4. Address of your Employer.
Email the requested information at [email protected] and indicate in the subject email ticket number #BIR-990368551583, to respond.
Lastly, please be informed that the filing and submission of the Employees’ BIR Form 2316 by your EMPLOYER should have been done on the Revenue District Office where your employer is registered.
However, due to Data Privacy Act of 2012 and Section 270 of the National Internal Revenue Code, as amended, the Revenue District Office (RDO) can only provide you a copy of your own BIR Form 2316 if they verify, in their records, that your EMPLOYER have filed the aforesaid BIR Form in your behalf.
Hence, you may ask your previous employer for the copy/ies of your Certificate of Compensation Payment/ Tax Withheld (BIR Form 2316) because all taxpayers are required to preserve their accounting records for the period of 10 years in accordance with the Revenue Memorandum Circular No. 29-2019.
During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Apr 20, 2023 12:08:53 AM, your request will be closed.
