Hi I would like to request for BIR 2316 form for personal matter. I already tried to request from my previous company however they haven't reached out to me yet for the response of my request. My contract to them were terminated before the year end.

Dear Ms. Federio:
I refer to my letter of Sep 24, 2023 06:11:51 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for BIR 2316.
In reply, BIR Form No. 2316 is a form issued by your employer (A Certificate). Hence, you may request for the issuance and/or re-issuance of the said documents to the issuing company. You must be issued of the copy of the said form on or before January 31 of the succeeding year.
With the employer's obligation to give you the original copy of the form, it is therefore your right to request said copy from your employer.
While our aim is to provide information whenever possible, in this instance the Revenue District Office (RDO) where your employer is registered would take longer to provide you the information you have requested. They have to verify if your employer has submitted to them the List of Employees Qualified under substituted Filing of Income Tax Return (Annex F). Furthermore, the date of filing should also be given for the RDO to be able to verify at the fastest possible time.

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Dec 18, 2023 03:29:14 AM, your request will be closed.
