Hi,

I would like to request a copy of BIR 2316 for employment purposes as part of our company's requirements.

I know that I can also get it with my previous employer however due to covid, I am unable to go in Manila as theres no public tranporation here in my province.

I refer to my letter of Nov 06, 2020 07:11:55 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for BIR 2316.

In order for us to work further on your request, , kindly email us the TIN, complete business name and address of your employer from  CY 2015 to 2019 for us to be able to properly endorse your request to the concerned Revenue District Office. Furthermore, please email us another valid ID containing your birthdate, signature, and photograph at [email protected], for validation purposes.

Your 2020 BIR Form No. 2316 (Certificate of Compensation Payment/Tax Withheld) should be issued by your previous employer. As mandated by law, every employer shall issue BIR Form No. 2316 to every employee if employment is terminated, on the day on which the last payment of compensation is made.  

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Feb 01, 2021 01:46:25 AM, your request will be closed.

Our response to your request is due on Nov 27, 2020 07:11:55 PM. Unfortunately, it is taking longer than expected to deal with your request because the concerned office has still a lot of requests that are needed to process may be due to the imposed quarantine measures brought by this COVID-19 pandemic and the massive flood caused by the recent typhoon.

While our aim is to provide information whenever possible, in this instance this Office does not have the information you have requested. Please be informed that your 2020 BIR Form No. 2316 (Certificate of Compensation Payment/Tax Withheld) should be issued by your previous employer. As mandated by law, every employer shall issue BIR Form No. 2316 to every employee if employment is terminated before the close of such calendar year, on the day on which the last payment of compensation is made.
