I would like to request for a copy of my BIR 2316 for the following year:

Dear Mr. Rosete:
Thank you for your request dated Jan 30, 2023 under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for BIR 2316.
In reply, Please be informed of the following:
A.) On your Request for BIR Form 2316 for the Taxable Year 2006 to 2011 under Arlo Aluminum Comp, Inc.:
It would be helpful and highly appreciated if the TIN is provided because your request will be forwarded to the concerned Revenue District Office (RDO) where your former employer submit their employees’ BIR Form 2316 and where your former Employer is registered.
Upon verification in our database, no record has been found pertaining to your former Employer's Taxpayer Identification Number (TIN).
A Certification of the Transmittal from your Former Company that You are included in the 'Annex F' received by the BIR-Revenue District Office will be required from you ("Annex F" from the company duly stamped by the BIR in which your name is included in the transmittal).
On the other hand, may we then suggest that you refer directly to your former employer as the said document was originally from the company and should have been provided to you after it has been filed in the BIR. It is also mandated by law that every employer shall issue BIR Form No. 2316 to every employee before the close of such calendar year, or if employment is terminated, on the day on which the last payment of compensation is made.
B.) On your Request for BIR Form 2316 for the Taxable Year 2011 to 2021 under SEAPAC Philippines:
It will be endorsed to the concerned BIR Office - Regular Large Taxpayer Audit Division III for appropriate action. The office concerned can only provide you a copy of your own BIR Form 2316 if they verify, in their records, that your employer have filed in your behalf covering the years 2015 to 2021.
We received your request on Jan 30, 2023 and will respond on or before Feb 20, 2023 04:14:59 PM, in accordance with the Executive Order's implementing rules and regulations.

Hi FOI Team,
My TIN used in Arlo Aluminum Company, Inc. is 244-786-078-000. I tried to request from their good office but no longer available since it was too old.
Also, I would like to clarify why they can only provide 2015 to 2021 while I started working from Seapac Philippines, Inc on May 2011.
It is very important for me to have my very first BIR 2316 in those respective companies. I hope you can help me on this.

You asked for BIR 2316.
Response to Request
After careful consideration, we resolve to grant your request for the years 2016, 2018, 2019, 2020 and 2021. A copy of your requested information was sent to the email address you have provided.
However, based on the reason stated below, we resolve to deny your request as to the following information:
Copy of your ITR for the years 2011-2014:
This Office does not have the information you have requested (ITR) since it was only starting 2015 when the employers were required to furnish the BIR with scanned copies of BIR Form No. 2316.
Copy of your ITR for the years 2015 and 2017:
We regret to inform you that your request cannot be processed because your employer failed to submit a CD of scanned copies of Certificate of Compensation Payment/Tax Withheld (BIR Form 2316) for the year 2015 and 2017.
For your guidance, please refer to the Revised People's Freedom of Information Manual for the Bureau of Internal Revenue, which is available for download at the Bureau's Official Website or www.bir.gov.ph.
