Hi!
I would like to request a copy of my BIR 2316 from. My previous employer is unresponsive and has been ignoring my messages.

Dear Ms. Austria:
I refer to my letter of Nov 09, 2023 11:16:44 AM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for BIR Form No. 2316.
In reply, please be informed that you may secure your Certificate of Compensation Payment/Tax Withheld (BIR Form 2316) from your employer for the Calendar Year 2022.
BIR Form No. 2316 is a form issued by your employer (A Certificate). Hence, you may request for the issuance of the said documents to the issuing company. You must be issued of the copy of the said form on or before January 31 of the succeeding year.
With the employer's obligation to give you the original copy of the form, it is therefore your right to request said copy from your employer.
While our aim is to provide information whenever possible, in this instance the Revenue District Office (RDO) where your employer (s) is/are registered would take longer to provide you the information you have requested. They have to verify if your employer (s) has submitted to them the List of Employees Qualified under substituted Filing of Income Tax Return (Annex F). Furthermore, the date of filing should also be given for the RDO to be able to verify at the fastest possible time.

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Feb 01, 2024 04:23:56 AM, your request will be closed.
