June 13, 2023 Dear Ms. DEMOHINA: I refer to my letter of Jun 08, 2023 04:28:33 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for BIR Form No. 2316. If you are an Employee for the period April 19, 2019 to June 08, 2023, your EMPLOYER is required to issue a copy of your BIR Form 2316 for Calendar Years 2019 to 2023, quoting that “ALL EMPLOYERS WITH EMPLOYEES, WHETHER OR NOT THEY ARE MINIMUM WAGE EARNERs (MWEs), ARE REQUIRED TO ISSUE BIR FORM NO. 2316. BIR FORM NO. 2316 SHOULD BE ISSUE ON OR BEFORE JANAURY 31 FOLLOWING THE CALENDAR YEAR, OR, IF THE EMPLOYEE IS TERMINATED BEFORE THE END OF THE CALENDAR YEAR, ON THE DAY THE LAST SALARY OF THE EMPLOYEE IS PAID” Please coordinate with them and ask for the copies of your BIR Form 2316 from the Calendar Years 2019 to 2023 if you have not receive a copy. As an added information, BIR Form No. 2316 issued during the Year 2019 is already unavailable per records of the Revenue District Office (RDO) where your employer is registered.
