June 6, 2022 Dear Mr. Elehandro Taytay: Greetings! Thank you for your request dated Jun 05, 2022 under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch. Your request You asked for BIR 2316 and 1905. Response to your request We were able to determine that your request cannot be counted as a valid FOI request as this is part of the frontline service of the BIR, hence, your request is denied. In this regard, we would like to advise you to visit the BIR District where you filed your 1905 and request from them copy of stamped received 1905. Please bring your two valid identification cards for verification purposes. In addition, we refer you to Section 6 of Revenue Regulations (RR) 10-2008 wherein employers are required to furnish every employee from whose compensation taxes have been withheld BIR Form 2316 Certificate of Compensation Payment/Tax Withheld on or before January 31 of the succeeding year or if employment is terminated before the close of such calendar year, on the day on which the last payment of compensation is made. Failure to furnish the same shall be a ground for the mandatory audit of payor's income tax liabilities (including withholding tax) upon verified complaint of the payee. Hence, we suggest that you coordinate with your employer (2021) as they are the ones who prepare your BIR Form 2316 Certificate of Income and Tax Withheld and issue the same to their employees. Otherwise, you may try to request a copy of your BIR Form 2316 with the Revenue District Office (RDO) where your employer is registered and submits reports only if your employer submitted the same to them.
