Dear Algen Mohamad Rasul Landas,
Thank you for your request dated Jul 12, 2023 10:36:38 AM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.
You asked for Arrangement of Labor force for Foreign Companies in Philippines.
All foreign nationals who intend to work in the Philippines are required by the government to secure an Alien Employment Permit AEP from the Department of Labor and Employment (DOLE). This permit authorizes a foreign national to engage in gainful activities provided that no domestic manpower is available for the particular designation
Aside from the AEP, foreign nationals who intend to work in the Philippines shall also secure Pre-Arranged Employee Commercial Visa or “work visa” and Provisional Work Permit or PWP, if necessary, from the Bureau of Immigration.
AEP may be issued by the DOLE after the determination of the non-availability of a person in the Philippines who is competent, able, and willing at the time of application to perform the services for which the alien is desired.
As a general rule, their employment arrangement is governed by the labor code of the Philippines.

I would like to follow up a question, is there any percetages of preferential labor work force, for example, 70% Filipino and 30% Foreign in Foreign Owned Company in the Philipppines. If we have that arrangement, I will be glad to be will informed regarding the legal basis of this matter.
