Hi, gusto ko lamang magtanong ano ano ang karapatan namin na empleyado under agency, Scenario, 1. Sa school kami na deploy non teaching staff, office's based since nag announced na walang pasok kami po ba ay no work no pay ren sa lagay na yun. Anyway monthly rate po kami

September 7, 2023 Dear Severhea DE LUNA, Thank you for your request dated Sep 04, 2023 11:41:02 PM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch. You asked for Ano ang karapatan ng empleyado under agency. The Department of Labor and Employment (DOLE) has issued Department Order No. 174, series of 2017 (DO 174), providing a new set of guidelines to govern contracting and subcontracting. As a general rule, workers of Agencies/contractors shall have rights embossed in the Labor Code with the owners of these Agencies as their employers. Anent the issue you have raised, may we provide you with a copy of the DOLE Labor Advisory 17 series of 2022 for your perusal. With regard to the payment of wages, Section 2 of the Advisory provides for the following: 1. If unworked- No work no pay policy shall apply, except if there is a favorable company policy. 2. If worked, a six-hour work shall suffice for a complete pay for the day. If work is below 8 hours, a proportionate pay computation shall apply, without prejudice to favorable company policy or practice by the company.
