Dear Mr. Go:

I refer to my letter of Sep 12, 2023 12:16:32 AM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for Annual Income Tax return copy.

In order to identify or locate the requested information, we are seeking for further clarification specifically:

1. Did you have a Registered Business between the period 2022 to 2023? Or were you an Individual Earning on Purely Compensation Income from the period 2022 to 2023?
2. Withstanding your answer to the first and second query, did you file an ITR for the cited period?

As an added note/reference, if you are an Employee for the period 2022 to 2023, your EMPLOYER is required to issue a copy of your BIR Form 2316 for aforesaid years pursuant to Section 2.83.1 of Revenue Regulations No. 02-98, as amended which provides that “The EMPLOYER shall furnish each employee with the original copies of Form No. 2316 xxx.” As proof that your taxes were withheld. This will serve as your Income Tax Return (ITR).

Kindly coordinate with your employer if you have not receive a copy of your BIR Form 2316 for Calendar Year 2022 to 2023.

Hi,

For the questions regarding your message here are my answers:

1. I am an Individual Earning Purely Compensation Income from the period 2022 to 2023
2. I didn't file any ITR on the cited period.

I already have a copy of my BIR form 2316 from my employer. The reason why I want a copy of my Annual Income Tax Return is I am planning to get a Tax Residency Certificate for Treaty Purposes (BIR Form No. 0902)

Can you help me with this? Thank you!

In reply, we called your mobile number today, December 13, 2023 to validate your existing eFOI request, however, it was unsuccessful.

Relatively, the BIR Form No. 2316 that was issued to you by your employer as a proof of taxes withheld which also serve as your Annual Income Tax Return (AITR) per Revenue Regulation 2-98, as amended.
