I just would like to know what goods are prohibited and allowed to be procured during the Election Ban period.

Dear Ms. Aytona:
This refers to your query requesting guidance on matters concerning the election ban protocols for the procurement of goods in relation to the May 2022 National Elections.
Paragraph (w) of Section 261 of the Batas Pambansa No. 881 or Omnibus Election Code (OEC) prohibits the construction of public works, delivery of materials for public works and issuance of treasury warrants and similar devices forty-five (45) days before the date of election, except for projects or works exempted under Section 261 (v).
The GPPB released previous issuances to guide procuring entities in harmonizing with the election ban guidelines from the Commission on Elections, to wit:
a) GPPB Resolution No. 12-2009, dated 27 November 2009 (May 2010 National and Local Elections);
b) GPPB Circular No. 04-2012, dated 23 November 2012 (May 2013 National and Local Elections); and
c) GPPB Resolution No. 21-2015 dated 18 August 2015 (May 2016 National and Local Elections)
d) GPPB Resolution No. 03-2019 dated 07 February 2019 (May 2019 National and Local Elections)
In so far as the latest issuances on the conduct of procurement during the May 2022 National and Local Elections is concerned, we have yet to issue said guidelines as we await the release of the latest resolution by the Commission on Election providing for the calendar of activities and periods of prohibited acts in connection with the May 2022 National and Local Elections.
We hope to have provided sufficient guidance on the matter. Note that our reply is based solely on the facts and circumstances presented in your email, and on the evaluation of the GPPB-TSO Officer assigned to address email and phone-in queries for the day. The same may not, therefore, be applicable given a different set of facts and circumstances, nor does it serve as the official position of the GPPB.
