Greetings from the National Privacy Commission (NPC)!
Thank you for your request dated 19 August 2024 at 11:16 P.M. under Executive Order No. 2, s. 2016, on Freedom of Information (FOI) in the Executive Branch.
Your request
You inquire whether organizations or individuals have the legal or constitutional right to compel someone to disclose their vaccination status, and what the legal or constitutional basis for such a right might be, if it exists.
Response to your request
While we aim to provide information whenever possible, in this instance, your request is not a valid FOI request but an inquiry that should follow our process under the NPC citizen’s charter.
Under Executive Order No. 2, s. 2016, it provides for the guidelines on full public disclosure and transparency in the public service which covers only access to information, official records, public records, and to documents and papers pertaining to official acts, transactions or decisions, as well as to government research data used as basis for policy development.
In this regard, inquiries on data privacy should follow the guidelines provided in the citizen’s charter of our agency, which you may access here: https://privacy.gov.ph/sending-general-inquiries/
Nonetheless, to assist you with your concern, we have forwarded your inquiry, name, and email address to our Public Information and Assistance Division ([email protected]) for the drafting of an appropriate response. You may expect our written response within 3-7 working days.
Your right to request a review
If you are dissatisfied with our response to your FOI request, you have the option to request an internal review. To initiate this process, kindly submit your written appeal for review addressed to Privacy Commissioner Atty. John Henry D. Naga at [email protected]. Please provide a detailed explanation of your dissatisfaction with our response within 15 calendar days from the date of receiving this response. We will conduct the review and communicate the outcome within 30 calendar days from the receipt of your review request.
Should you remain unsatisfied with the review outcome, you retain the right to appeal to the Office of the President under Administrative Order No. 22 (s. 2011).
