Hi I would like an information about article 94 in labor code. Because its not specified what type of employment (ex. Regular, Probatiobation) Just asking a broad explaination thank you.

Thank you for your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch. You inquired about the applicability of holiday pay to different types of workers.

Holiday pay refers to additional compensation provided to employees during regular holidays.

Holiday pay is a legislated benefit aimed at protecting labor rights. It ensures workers receive their income despite work interruptions during holidays and allows them to participate in national celebrations of historical and cultural significance.

Applicability to Employees:

  1. Daily-Paid vs. Monthly-Paid Employees:
    • Both daily-paid and monthly-paid employees are entitled to holiday pay.
  1. Employee Status:
    • Holiday pay applies to all employees, regardless of employment status. This includes regular, probationary, casual, project-based, seasonal, and fixed-term employees.
