Dear Ms. Lim:
We have received your request dated January 27, 2025 under Executive Order No. 2 (s. 2016) on Freedom of Information in Executive Branch.
You specifically requested for data on a 200 cubic meter elevated steel water tank located in Dacoville, Brgy. Dumoy, Toril, District Davao City.
Upon review of our data registry, we have already responded to your previous similar data request, specifically,
structural plans of construction of 200 cu.m capacity elevated steel tank and facilities for Dacoville Subdivision in Brgy. Dumoy, Toril District, Davao City with FOI Tracking number: FOI-010625-01 which we have denied due to information requested under Exceptions List on January 9, 2025.
While our aim is to provide information whenever possible, in this instance we are still unable to provide the information you have requested due to the same exception under section 5 of the Inventory of Exceptions to EO No. 2 (s. 2016) or "Information, documents, or records known by reason of official capacity and are deemed as confidential, including those submitted or disclosed by entities to government agencies, tribunals, boards, or officers, in relation to the performance of their functions, or to inquiries or investigation conducted by them in the exercise of their administrative, regulatory or quasi-judicial powers."
The reason why that exception applies to the data requested is due to the details with regards to its confidentiality and limited shareability.
We hope you are satisfied with the response to your FOI request. However, if you feel otherwise, you may request to review the response we have given by writing to DCWD's General Manager within 15 working days from the date when you received the letter response. We would suggest that you explain in detail why you are not pleased with the response you have received. We will complete the review and tell you the result within 30 working days from the date when we received your appeal.
In the event that you are still not satisfied with the result of the review, you may appeal to the Office of the President under Administrative Order No. 22 (s. 2011).
