May I know if the IRR of RA 12001 has been signed and published? If not, can the LGU implement the provision on waiving of interests and penalties on unpaid real property tax? Would appreciate your immediate response. Gilda Salvacion A. Diaz

Dear eFOI user,

Thank you for your request dated yesterday, made under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.

To answer your query:

  1. The IRR of RA 12001 has not yet been published but undergoing procurement processes for its publication.
  2. Thus, on your 2nd query, If you are to avail the amnesty and would want to pay in full, you need not wait for the IRR and the LGU may opt to collect the taxes immediately. However, should you wish to avail of installment payment for your arrears, the LGU has to adopt the mechanism thru an ordinance before it can allow installment payments prior to availment of the tax amnesty, which will be provided and effective after the publication of the IRR.
