Thank you for your requestSeptember 23, 2024d Sept. 20, 2024, made under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.
We have received your request on Request Copy of Income Tax Return (ITR) and/or BIR Form No. 2316 which will be use for Visa Application.
Please be informed, that you are registered in the BIR System as Local Employee. The duty therefore to provide you a copy of your Income Tax Return (ITR) and/or BIR Form No. 2316 for a taxable year(s) rests upon your employer. Your “ITR” is your personal document and as such your employer must release said document to you as a matter of right or better yet, if you have your payslips for the said year, you can give the same to help them come out with your form 2316.
Kindly coordinate with your employer/s if you have not receive a copy of your BIR Form 2316 for Calendar Year(s) 2014 and 2023 (in case your employment with your employer has ended last year).
If you want to continue this request, kindly provide us the following details:
- Name of your Employer/s for Calendar Year(s) 2020 to 2023;
- TIN of your Employer/s; and
- Employers Business Address.
Your request for information will be endorsed to the Revenue District Offices (RDOs) where your Employer/s is/are registered. The requested information will be provided to you once your Employer/s submitted a Notarized Certified List of Employees Qualified Under Substituted Filing of Income Tax Return (Annex F) per Revenue Regulations No. 11-2018, in which your Name is included in the List.
For ITR and/or BIR Form No. 2316 issued for Calendar Year(s) 2014 to 2019, please be informed that records/files of ITR and/or BIR Form No. 2316 for the aforementioned years were already sent to Archive as it was more than four (4) years of Retention Period per Revenue Memorandum Circular (RMC) No. 73-2008.
Hence, you may ask for a copy/copies of your BIR Form No. 2316 to your previous employer (s), because All Taxpayers are required to preserve their accounting records for the period of ten (10) years in accordance with the RMC No. 29-2019.
