Dear eFOI user,
About my letter dated [date], at [time], regarding your request made under Executive Order No. 2, s. 2016 on Freedom of Information in the Executive Branch; specifically your request on BIR Form No. 2316 for Calendar Year(s) 2023 to 2024.
After careful consideration, you are to coordinate with your EMPLOYER as the same is Mandated to Issue the BIR Form No. 2316 for the Calendar Year 2023, pursuant to Section 83 of the 1997 Tax Code and Section 2 [2.83.1] of Revenue Regulations (RR) No. 3-2002, respectively. The EMPLOYER/S shall furnish each Employee/s with the Original Copies of BIR Form No. 2316 as Proof that your Taxes were Withheld and this will serve as your Income Tax Return (ITR).
EMPLOYER is required to issue BIR Form No. 2316 on or before January 31 of Every Year and On the Day the Last Payment of Compensation is Paid. If you want to continue your lodged request and in order to identify or locate the requested information, we are seeking for further clarification specifically:
- Kindly provide the Name of your Employer for the Period of 2023;
- TIN of your Employer;
- Employer/s Business Address; and
- Your TIN Number?
Email the requested information at [email protected] and [email protected] as this contain sensitive information.
However, the BIR Revenue District Offices (RDOs) does not have yet a copy of your Income Tax Return and/or BIR Form No. 2316 for Calendar Year 2024. The RDO get a hold of the said document upon submission of your employer to them on or before February 28, 2025.
