b.) the risks and its allocation, and
c.) the standard concession agreement in the Philippines

Below is our response to your message last December 07, 2021 seeking for more information from us regarding our requested Concession Agreement (with complete Annexes).
Knowing that the Philippines is promoting Public-Private Partnership (PPP) and is a leading country in the Southeast Asia for PPPs, our company is researching and looking at the PPP transportation market of the country as a potential business market to further expand our current activities Philippines. We would like to understand how the government and other investors partnered/collaborated with each other in the previous projects. Therefore, we would like to request and study the Concession Agreements with complete Annexes to help us understand:
1. the basic characteristics of the project(s)
2. the risks and its allocation, and
3. the standard Concession Agreement in the Philippines

You asked for Mactan-Cebu International Airport Passenger Terminal Building - Concession Agreement with Annexes.
Response to Request
We are well pleased with your intention to research on potential business markets for our country, the Philippines. However, as much as we would want to provide you with the information that you need we regretfully decline your request. We would like to bring to your attention that there is a pending case on the Anti-Dummy Law which includes some of our concessionaires' employees. This may necessarily require the information you are requesting to be used as evidence in the court where the case is pending. With that, we are sorry we cannot grant your request.
Your right to request a review
If you are unhappy with this response to your FOI request, you may ask us to carry out an internal review of the response by writing to Mr. Julius G. Neri, Jr., General Manager and CEO of MCIAA, via [email protected] . Your review request should explain why you are dissatisfied with this response, and should be made within 15 calendar days from the date when you received this letter.
