June 13, 2023 Dear Ms. Bartolome: I refer to my letter of Jun 09, 2023 03:46:01 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for Income Tax Return and/or BIR Form No. 2316. In order to identify or locate the requested information, we are seeking for further clarification specifically: 1. Did you have a Registered Business between the period April 1, 2023 to May 31, 2023? Or were you an Individual Earning on Purely Compensation Income from the period April 1, 2023 to May 31, 2023? If you are an Employee for the period April 1, 2023 to May 31, 2023, your EMPLOYER is required to issue a copy of your BIR Form 2316 for Calendar Year 2023. that “ALL EMPLOYERS WITH EMPLOYEES, WHETHER OR NOT THEY ARE MINIMUM WAGE EARNERs (MWEs), ARE REQUIRED TO ISSUE BIR FORM NO. 2316. BIR FORM NO. 2316 SHOULD BE ISSUE ON OR BEFORE JANAURY 31 FOLLOWING THE CALENDAR YEAR, OR, IF THE EMPLOYEE IS TERMINATED BEFORE THE END OF THE CALENDAR YEAR, ON THE DAY THE LAST SALARY OF THE EMPLOYEE IS PAID” The Revenue District Office (RDO) gets a hold of the said BIR Form No. 2316 upon submission of your employer to the district on February 28, 2024.
