Good day! In reference to your e-FOI request regarding “About Ibon Foundation if they are under the umbrella organization of CPP NPC NDF”, please be advised that the National Security Secretariat is bound by Memorandum Circular (MC) 78 dated 14 August, 1964 entitled "Promulgating Rules Governing Security of Classified Matters in Government Offices." Section IV paragraph 17 letter C of MC 78 states: Section IV Confidential Matter 17. Definition. -Information and material (matter) the unauthorized disclosure of which, while not endangering the national security, would be prejudicial to the interest or prestige of the nation or any government activity, or would cause administrative embarrassment or unwarranted injury to an individual or would be of advantage to a foreign nation… Examples… C. Routine Intelligence Reports. In relation thereto, Section 4 of Executive Order (EO) No. 2 series of 2016, also known as Freedom of Information, states: "Access to information shall be denied when the information falls under any of the exceptions enshrined in the Constitution, existing law or jurisprudence… 2. Privileged information relating to national security, defense or international relations…5. Information, documents or records known by reason of official capacity and are deemed as confidential, including those submitted or disclosed by entities to government agencies, tribunals, boards, or officers, in relation to the performance of their functions, or to inquiries or investigation conducted by them in the exercise of their administrative, regulatory or quasi-judicial powers." Pursuant to the foregoing MC and EO, the data being requested falls under the exception of privileged information relating to national security, defense or international relations; and records of proceedings or information from proceedings which, pursuant to law or relevant rules and regulations, are treated as confidential or privileged. As in the cases of Almonte vs. Vasquez, G.R. No. 95367, and Chavez vs. Presidential Commission on Good Government, G.R. No. 130716 on 09 December, 1998: Military, diplomatic and other national security matters which in the interest of national security should not be divulged.
